Gutters in Madison County, AL: Unincorporated Area Rules

Having gutter work done in unincorporated Madison County, AL? Outside the city limits, the county's offices apply, not Huntsville's or Madison's. Here's the county's permit wording, its lot drainage sheet, what its Public Works department handles, and who to call.

The county's permit wording

The county's permit document lists two triggers that come up here:

  • "All construction, renovations, repairs, alterations, or additions costing $1000 or more"
  • "Roofing or re-roofing - regardless of cost"

Gutters aren't named, and no exemption list is shown. National average prices for a full install run from $1,135 to $3,200 depending on the source, so a full gutter system can land above that $1,000 line, while an average repair of $395 sits below it. Whether the line applies to gutter work is the county's call, not this site's. Call and ask: Madison County Inspection, 256-746-2950, 266-A Shields Road, Huntsville 35811.

The county's lot drainage sheet

The county has a Lot Drainage Inspection Information Sheet that gets more specific than anything read for the two cities:

ItemWhat the sheet says
Roof drains"Roof drains directed a minimum 5' away from home." It cites IRC 801.3.
Grade"minimum of 6" within the first 10 feet". It cites IRC 401.3 and county subdivision regulations.
Side lots"Side lot line swales to direct lot drainage", toward county right of way or a drainage easement as required.
LandscapingMust not alter drainage structures critical to a subdivision's stormwater plan.

Read that for what it is. It's a lot-drainage inspection sheet that applies before a certificate of occupancy and cites the 2003 IRC, so apply it as the county's stated standard for that inspection, not as a rule on every existing home. Even so, it's a useful yardstick. Bob Vila says standard downspouts discharge only 1 to 3 feet out, so a house with bare elbows at the wall may not meet the 5-foot line.

If a shared swale runs along your side lot line, don't fill it, block it or run new downspout lines into it before talking to the county.

Who manages drainage

The county's stormwater page says Public Works is "responsible for managing stormwater and drainage in unincorporated Madison County." This site couldn't confirm a direct phone number for it, so check the county's site, or ask County Inspection at 256-746-2950 which office to call.

No ordinance read for this site says where a downspout may discharge relative to a neighbor or a road, so this site doesn't state a rule. The county is the place to ask.

Depressions and sinkholes

The county's 2016 hazard plan rates sinkholes a Slight risk, describing them as "Usually small in size, but frequent." No source ties gutters to causing or stopping sinkholes. If a downspout's water is concentrating near a low spot that looks like one, raise it with the county.

Cost and sizing

No county contractor's price was collected for this site. See the cost guide for national figures with sources and dates. For sizing, NOAA's rates are for downtown Huntsville and move slightly by address, so treat them as close, not exact. The size calculator works the same way.

Questions homeowners ask

Does the $1,000 rule apply to gutters?

The county's list doesn't name gutters. Call County Inspection at 256-746-2950 with your job and price.

Do my downspouts have to discharge 5 feet from the house?

That line is on the county's lot drainage inspection sheet, so it's the stated standard for that inspection. Ask the county how it applies to an existing home.

Am I inside a city or in the unincorporated county?

This site can't confirm that by community name. Check your tax bill, or ask County Inspection.
